A federal agent injured from a gunshot inside a downtown garage last fall told investigators his hands were full when his firearm sent a round into his leg while it was holstered, police reports obtained by 12 News reveal.
The records, provided by Milwaukee police in response to a public records request, include statements from the injured agent and the officers and detective who witnessed the Nov. 29 shooting inside the building near 8th and Michigan in downtown Milwaukee.
According to the records, the injured agent told investigators he and other agents and officers had just returned to the building after serving a search warrant earlier that morning.
The agent, whose name is redacted in the documents, said he was getting out of his vehicle just before the gunshot.
"[The agent] further stated that he had his keys in his left hand along with his water bottle and lunchbox in his right hand when he exited his vehicle," an investigator wrote in the report. "[The agent] stated that he started closing his vehicle door and heard a gunshot."
The agent, according to the records, thought the gunshot came from one of the guns they seized while executing the warrant, but looked down and saw his own gun on the ground.
"[The agent] knew at that time that his firearm went off in the holster shooting him in the leg."
The documents identified the agent's gun as an agency-issued Sig Sauer P320, a weapon at the center of several lawsuits where officers and agents claim their P320's fired without the trigger being pulled.
12 News Investigates first exposed the concern about the P320 after a July 2020 incident injured Milwaukee police Officer Adam Maritato. His partner's gun fired that night, hitting Maritato in the leg. Both are now part of a lawsuit against the gunmaker.
The 12 News investigation has now counted six incidents in the state where officers and agents reported accidental discharges of their P320s.
Milwaukee police brass, the police union and city officials agreed to trade out the P320s for the Glock 45, which supervisors are now training new recruits.
